Terms of Service

The Site and the Scan are intended for businesses and professionals. By submitting the Scan, you confirm that you are doing so in the course of your business or profession and not as a consumer, and that you are authorised to act on behalf of the company you describe.

• The Scan is free and does not oblige you to buy anything.
• You must only submit a company website or profile link that belongs to you or to a business you represent, and the information you give us must be accurate to the best of your knowledge.
• Please do not include personal data about other people, or confidential information, in your questionnaire answers beyond what is needed to describe your business processes.
• We may decline to run a Scan or send a report at our discretion, for example if a submission appears automated, incomplete or outside the kind of work we do.
• We may change, pause or stop offering the Scan at any time.

Your AI opportunity report is prepared with the help of an AI model and reviewed by our team before it is sent. It is an indicative, high-level assessment based on the information you provide and on the public content of your website.

• Any figures in the report, such as estimated time or cost savings, are estimates only. They are not a quote, a promise of results or a guarantee that a solution is technically feasible.
• The report is not legal, financial, tax or other professional advice. You remain responsible for any decisions you make based on it.
• Feasibility, scope and price of any actual work are only established through a paid Discovery engagement or another written agreement.

Using the Site, submitting the Scan, receiving a report or booking a call does not create an agreement for us to provide services. Any paid work is carried out only under a separate written agreement signed by both parties, and that agreement’s terms apply to that work.

• The Site, its content and design, the Scan tool and our report format belong to Misaki Media or its licensors.
• You may use your report for your own internal business purposes. You may not publish, resell or redistribute it without our written permission.
• The information you submit remains yours. You give us permission to use it to prepare your report and to follow up with you, as described in our Privacy Policy.
• We may use anonymised, aggregated insights from Scan submissions (which cannot identify you or your company) to improve our services.

You agree not to:

• use the Site or the Scan for any unlawful purpose;
• submit automated, bulk or false Scan requests;
• attempt to disrupt, overload, gain unauthorised access to or reverse-engineer the Site or the Scan; or
• copy or scrape content from the Site by automated means.

The Site links to third-party services, such as the scheduling service used to book a call. We are not responsible for the content, availability or practices of those services, and their own terms and privacy policies apply.

We provide the Site and the Scan “as is” and “as available”. We do not guarantee that they will always be available, uninterrupted or error-free, and we may update or change them at any time.

To the maximum extent permitted by law, Misaki Media is not liable for any loss or damage arising from your use of the Site, the Scan or your report, including any decision you make based on the report, and including indirect or consequential loss such as lost profits or lost savings.

Nothing in these terms limits or excludes liability that cannot be limited or excluded under Dutch law, including liability for damage caused by our intent or deliberate recklessness (opzet of bewuste roekeloosheid).

Our Privacy Policy explains how we handle personal data collected through the Site and the Scan. It forms part of how the Site operates but is not a contract term you are asked to agree to.

We may update these terms from time to time. The version published on the Site, with its “Last updated” date, applies from that date. If you keep using the Site after an update, the updated terms apply.

These terms are governed by the laws of the Netherlands. Any dispute arising from these terms or your use of the Site or the Scan will be submitted exclusively to the competent court in Amsterdam, the Netherlands.

If any provision of these terms is found invalid or unenforceable, the remaining provisions remain in effect. If these terms are translated, the English version prevails.
